§ 36.114. POLICE NON-REVERTING FUND FOR FORFEITED MONIES.

  • (A) A non-reverting fund is hereby established titled Clarksville Police Non-Reverting Fund for Forfeited Monies. The fund is established for the purpose of receiving, holding and dispersing monies that have been found or seized by the Police Department and forfeited for its use and for the purpose of receiving, holding, and dispersing monies that have been ordered by the courts to be paid to the Police Department as restitution. The Police Department shall deposit monies that have been seized and forfeited from criminal defendants into this fund and shall deposit monies that have been received as a result of a court order that restitution be paid to the Police Department.
    (B) Following its annual court-ordered inventory, the Police Department may use funds from the Clarksville Police Department Non-Reverting Fund for Forfeited Monies for reasonable and necessary police department expenditures as allowed by law. Monies from the Clarksville Police Department Non-Reverting Fund for Forfeited Monies may be dispersed without appropriation in payment after:
    (1) The filing of a proper claim; and
    (2) The issuance of a warrant by the Clerk-Treasurer.
    (C) Authorization for the fund shall expire with the Police Department notifies the Town Council that the purposes of the fund no longer exist or a subsequent ordinance so provides and any funds remaining in the account shall be transferred to the General Fund.
