§ 50.51. MANDATORY COLLECTION AND DUTIES OF THE OWNER.

  • (A) Regular adequate refuse collection. The responsibility for removal of refuse, as defined in this subchapter, rests with the owner of the property, whether improved, unimproved, occupied or unoccupied All commercial users as defined in this subchapter shall:
    (1) Provide adequately sized containers and enclosures;
    (2) Provide an adequate number of appropriately sized containers;
    (3) Maintain a regular collection service at intervals adequate to meet the needs of the premises and comply with this subchapter, but in no event will collection be allowed between the hours of 7:00 p.m. and 7:00 a.m. except where the site is more than 300 feet, measured in a straight line, from the nearest residential use property line;
    (4) If the commercial user generates greater amounts of refuse during seasonal periods, the user is required to secure additional containers and enclosures for that period to keep refuse from public view and to arrange for additional collections;
    (5) Maintain the enclosure and containers in an orderly and sanitary condition;
    (6) If the commercial users generate additional containers, encloses, and pickups shall be provided; and
    (7) Recycling is encouraged.
    (B) Senior housing.
    (1) Distance. Enclosed containers shall not be located more 125 feet from the unit served.
    (2) Path of travel. The path of travel from the senior unit shall be at least four feet wide, free of any obstructions and free of stairs.
    (C) Multiple unit, shared single-family, commercial, industrial, or institutions.
    (1) Central collection. One large central refuse collection area is only permitted for developments or institutions that have janitorial staff that moves waste from every tenant or occupant to the enclosed container.
    (2) Distance. Enclosed containers shall not be more than 200 feet from the business or multiple family unit served.
    (3) Compaction and baling equipment. Compaction and baling equipment is permitted only when performed by a dedicated janitorial staff and in compliance with the following:
    (a) Distance from residential uses. Compaction and baling equipment shall be enclosed in the same manner as refuse containers and shall be located at least 200 feet from residential uses.
    (b) Storage of bales. Storage areas for bales shall be enclosed in the same manner are refuse containers. Enclosed space shall also be allocated for pallets.
    (4) Enclosed. All outdoor commercial refuse shall be in enclosures that conceal all refuse from public view. Enclosures shall be closed at all times, except when depositing or collecting refuse.
    (a) Containers. Unenclosed containers are a violation of this subchapter.
    (b) Enclosures. Open enclosures are a violation of this subchapter.
    (D) (1) Any existing commercial enclosure that does not fully comply with the requirements of this section shall be fully abated by modification of the existing commercial enclosure, or by the removal of the commercial enclosure with replacement by a new commercial enclosure, in a manner such that the commercial enclosure serving the subject commercial property shall fully comply with all of the requirements of this section.
    (2) Any subsequently constructed commercial enclosure required by the provisions of this section shall fully comply with all of the requirements of this section.
