(A) A special non-reverting operating fund is established for the purpose of receiving and holding fees charged by the Parks Department and/or Parks and Recreation Board in regard to the water park known as Atlantis. This fund shall be entitled “Clarksville Parks and Recreation Non-Reverting Fund/Atlantis Water Park” and the moneys may be expended from this fund only upon the filing of a proper claim in issuance of a warrant by the Clerk-Treasurer after appropriation by the Town Council. Hereafter, the Clerk-Treasurer shall not deposit moneys received by the Parks and Recreation Department as activity fees from the operation of the water park known as Atlantis into the Parks Department's General Fund, but shall deposit those funds into said non-reverting fund.
(B) The Park and Recreation Department and the Park and Recreation Board are hereby required to use the non-reverting fund to the extent and in the manner allowed by law.
(C) The authorization for this non-reverting fund shall expire when the lease of the property known as the Atlantis Water Park terminates or as a subsequent ordinance provides, and funds in the account shall be transferred to the Park and Recreation Department General Fund.
